Terms of Service

Purpose and acceptance

These Terms of Service govern the use of the Spody application and of the spodyapp.com website, published by Forge & Co SAS (see the legal notice at the end of this page). By creating an account or using Spody, you accept them in full. If you do not accept them, please do not use Spody.

Who can use Spody

Spody is reserved for people aged 18 or over. There is no supervised-minor mode: your date of birth is checked at sign-up and an account that does not meet the age requirement cannot be completed. You must also have the legal capacity to enter into a contract, and you undertake to provide accurate information and keep it up to date.

What Spody is — and what it is not

Spody lets you propose sport activities, find and join those proposed by others, exchange messages with the people who joined, and track your sport history. Spody is not a dating service and must not be used to seek romantic or sexual encounters. Above all, Spody is not the organizer of the activities: each activity is proposed and run by the user who created it, under their sole responsibility. We do not verify our users’ identity, skill level, fitness, insurance or equipment.

Your account

You are responsible for keeping your credentials confidential and for everything done through your account. Tell us immediately at contact@spodyapp.com if you suspect any unauthorized use. You can review your linked devices and sign them out remotely from your settings.

Rules of conduct

Using Spody means committing to a respectful community. You agree not to:

• harass, threaten, insult or discriminate against anyone, or endanger another person;
• use Spody for romantic or sexual approaches, or post sexual, hateful, violent or unlawful content;
• impersonate someone else, create an account for another person, or post information you know to be false;
• publish or disclose someone else’s personal data — in particular a phone number given to you for a meet-up, which must be used for that meet-up alone;
• use Spody for advertising, canvassing, spam, or any commercial activity we have not authorized;
• attempt to disrupt, overload, scrape or circumvent the security of the service.

Your content

You remain the owner of the content you publish (activity descriptions, messages, photos, notes). You grant us the free, non-exclusive license needed to host, display and transmit that content to the users concerned, for the operation of the service and for as long as you publish it. You warrant that you hold the rights to it and that it does not infringe anyone else’s rights.

Meet-ups, risk and insurance

Sport carries inherent risks and meeting people you do not know calls for ordinary caution. You take part in activities at your own risk. It is up to you to make sure your health allows the activity, to have suitable equipment, and to hold the insurance cover required for your practice. We strongly recommend meeting in a public place, telling someone close to you where you are going, and stopping any activity that seems unsafe. Forge & Co SAS does not organize, supervise or insure the activities and cannot be held liable for what happens there.

Reporting and moderation

You can block a user and report a profile or a message from within the app. We review reports and may, depending on how serious the case is, issue a warning, remove content, suspend or permanently close an account. Where a decision affects your account we inform you and you may reply at contact@spodyapp.com. We may also remove content or suspend an account without notice where required to protect users or to comply with the law.

Price

Spody is currently free: creating an account, finding activities, joining them and using the chat cost nothing. Paid features may be introduced in future; in that case the price, the scope and the terms would be presented clearly before any purchase, and would never make features previously provided free chargeable retroactively.

Availability and changes to the service

We aim to keep Spody available and working, without being able to guarantee uninterrupted access: maintenance, updates, technical failures or events beyond our control may interrupt it. We may make the app evolve, and add, change or discontinue features. Where a change substantially reduces the service, we inform you within a reasonable time.

Liability

Forge & Co SAS is liable for its own failure to perform under these Terms, on the terms provided by law. We are not liable for the conduct of users, the content they publish, or what happens during an activity, nor for indirect damage such as loss of opportunity or loss of data attributable to you. Nothing in these Terms limits the rights you hold as a consumer under mandatory law, in particular the statutory guarantee of conformity.

Term and termination

These Terms apply for as long as you use Spody. You can stop at any time and delete your account permanently from your settings — deletion is immediate and irreversible. We may terminate your access in the event of a serious or repeated breach of these Terms, subject to the moderation process described above.

Governing law and disputes

These Terms are governed by French law. If you are a consumer, you keep the benefit of the mandatory protective provisions of the law of your country of residence, and you may bring proceedings in the courts of that country. Before any legal action, please contact us at contact@spodyapp.com so that we can look for an amicable solution. Consumers residing in the European Union may also use the European Commission’s online dispute resolution platform at ec.europa.eu/consumers/odr.
